The landmark case of Air India Cabin Crew Association vs. Yeshawinee Merchant, where the Supreme Court upheld Air India’s policy of differential flying ages for male and female cabin crew members;

Represented Air India in the High Court of Bombay when its pilots called a strike due to the SAARS epidemic and the High Court rejected the pilots’ claims;

Represented BEST when its transport division employees called a mass strike preventing the company from plying its buses. The strike was declared illegal;

Represented an MNC before the State Advisory Board in proceedings relating to the prohibition of employment under Contract Labour Act;

Vetted a trade association’s employee handbook from an Indian Law perspective. Conducted due diligence on the Indian subsidiary of a multinational bank with employees in Australia, Canada, Germany, India, Japan, Malaysia and South Africa which included Labour and HR issues;

Advised on labour-related issues in a merger and acquisition transaction, in association with Deloitte;

Advised a leading software company in a retrenchment exercise;

The firm is currently handling group matters involving service and recruitment regulations for a renowned Indian statutory entity engaged in infrastructure development;

Successfully contested on behalf of Air India during its transfer process of the entire Maintenance, Repair and Overhaul department to a separate legal entity consisting of around 7,000 employees.

SUMIT GUPTA
Partner

Sumit is the lead partner at the Delhi office with over 13 years experience in major practice areas of MVKini. He has extensive experience in advising clients on general corporate commercial transactions, service and arbitration matters and supervising related litigation at various forums and levels of the Indian court system.



Sumit advises government and private sector organizations on issues relating to service and labour laws apart from other regulatory issues.

Sumit has led several corporate commercial transactions as well as high stake litigation matters involving interpretation of statutes, commercial contracts and tender documents.

He has also advised government bodies in finalisation of model agreements for use in the highway sector.

Over the years, Sumit has advised government and private sector clients in the infrastructure sector. He specialises in the highways, roads, power, railways and aviation sectors. He has been advising clients on issues regarding tenders and contracts. He is also an expert in matters related to concession, EPC and consultancy services agreements. With his experience in the infrastructure sector, he continues to provide advice to the Indian government as well as private entities.

Tavinder Sidhu
Partner

Tavinder is an advocate with the Supreme Court of India. He is qualified to practice as a solicitor in the Senior Courts of England and Wales. Tavinder has active trial experience in mercantile, property, succession and criminal matters. He represents clients on issues relating to government contracts, tender laws and labour & employment related matters.

Tavinder’s expertise extends to arbitration appeals before various courts. He represents clients before arbitral tribunals relating to major infrastructure contracts on both item-rate and Build Operate Transfer bases.

Ved Prakash Gaur
Senior Advisor

Ved Prakash is an expert in labour law and issues relating to employment. He is part of MVKini’s litigation team.

He has a lot of experience in preparing service rules and standing orders for employment as well as procedures relating to disciplinary actions. He specialises in documentation of agreements between contractors, sub-contractors and principle employers.

He is advises clients and represents them at tribunals, commissions and courts.

Ved Prakash has mediated in and represented parties across the spectrum of labour disputes in India. He has also advised companies ensuring seamless completion of retrenchment exercise. Within his practice area of dispute resolution he has represented clients in sectors ranging from construction and engineering, entertainment and sports, hospitality, infrastructure and real estate.
