M. V. Kini
Founder

M.V. Kini’s desire to build something of his own and his passion for law inspired him to turn his back on a promising career in banking and turn to criminal law. Started out of one office with four employees in Mumbai back in 1978, MVKini has now grown its operational base to 14 locations around India with more than 145 employees.

The firm’s portfolio has grown and diversified over the years and now includes practitioners in corporate, banking, finance, environmental, consumer finance, infrastructure, customs and international business taxation law. This growth is fuelled by M.V. M.V. Kini is on the panel of lawyers representing the International Airports Authority of India (IAAI) and has personally represented IAAI in several landmark cases. From coming up with innovative solutions to end a standoff between the IAAI and the Mumbai municipality, effectively resolving the issue of the unionisation of the air-traffic control department to ending the Air India pilot strike, M.V. Kini is widely recognised as one of the foremost experts in aviation law in the country M.V. Kini is also recognised as an expert in prosecuting white collar crimes. He has led several high profile prosecutions in fraud cases in banks, both nationalised and private, including against cover-ups of scams in the financial sector in general.

In recent years he has represented various international business interests in India, helping them navigate the often-daunting legal and infrastructural set up in the country.

Working with pan-India entities like the National Highways Authority of India has in part led to the firm’s expansion in operations throughout the country. MVKini now also represents more than 63 international and local banks and in excess of 100 public sector undertakings. Drawing on his background and interest in banking he is the author of two books on the Negotiable Instrument Act and a separate practical guide for bankers dealing in consumer finance.

Ravi Kini
Managing attorney

Ravi is MVKini’s managing attorney. Ravi holds an LL.M in International Financial Laws from the University of Georgia, USA where he specialised in Derivatives Risk Framework.

Ravi is one of India’s leading practitioners of law relating to national and state highways projects. He is also renowned for his work in the aviation, government affairs, and banking sectors.

Ravi advises the National Highways Authority of India (NHAI) and state authorities on highways and related projects. He advises on international competitive bidding in Public Private Partnerships (PPP); He has a wealth of experience advising the Indian government on bid processes, and drafts and vets tender documents and contracts. He is skilled in incorporating Special Purpose Vehicles and executing concession agreements and contracts for selected bidders.

His expert knowledge comes from advising on a wide range of projects executed/funded in this way. They include the development of a free trade and warehousing zone, the creation of industrial training and skills development centres, the building of rail-related manufacturing facilities as well as ports terminals, IT parks and other urban transport projects.

Ravi’s public-sector experience gives him a unique understanding of how government functions. Ravi leads a team that effectively mediates industry concerns to the relevant government body to swiftly arrive at constructive outcomes.

His significant experience in the aviation sector has led him to advise on ground-handling issues a cross a number of airports. Ravi’s experience extends to advising bodies, such as IATA, on Competition Law issues. His extensive experience includes advising India’s national carrier. He negotiated and drafted the contracts for Air India’s purchase of 68 commercial aircrafts from Boeing, in a US$7 billion deal. He also assisted in the formation of its low-cost subsidiary, Air India Express. He regularly drafts and vet aircraft leasing agreements.

Ravi leads a team that supports Indian companies seeking access to foreign capital through external commercial borrowings (ECB). They regularly interpret RBI circulars and are able get swift clarification from the regulator as required. He and his team act as the lender’s legal counsel, participating in negotiations with borrowers ensuring compliance banking law and practise. Keeping the lender’s interests at the fore, they assist with securities’ creation and perfection of charge documentation. Els Reynaers Kini
Partner

Els Reynaers Kini is a partner at MVKini and heads the firm’s environment practice. She has law degrees from the Free University of Brussels, Belgium (magna cum laude), and the University of Delhi, India. She completed her LL.M. at the University of Georgia, USA, which included a thesis on the regulation of transboundary movement of hazardous wastes in the US and the EU.

Before moving to India in 2001, she worked as a lawyer on environment and energy-related issues at Allen & Overy in Brussels and at Giordano & Associates in Chicago.

Prior to obtaining her Indian law degree, Els worked as a researcher at The Energy and Resources Institute (TERI), New Delhi, where she headed the Centre for Global Agreements, Legislation and Trade. She worked closely with the Government of India on its WTO trade and environment negotiations. She taught environmental law on the TERI School of Advanced Studies’ Masters Programme.

Els specialises in environmental law, food safety regulations, nuclear law and international trade disputes.

She has extensive experience assisting companies with their environmental compliances as part of due diligence exercises, ongoing business operations and litigation processes. She helps clients chalk out their compliance strategy, which often includes obtaining or renewing environmental permits under the various environmental laws (including under the water; air; hazardous wastes; hazardous chemicals; e-Waste; pesticides and Environmental Impact Assessment regulations) and guides them through their interactions with various state pollution control boards and the central Ministry of Environment and Forests. She tracks developments in various multilateral environmental agreements and advises on repercussions for India-based companies.

Els is listed in the Who’s Who of Environmental lawyers. In the most recent 2016 edition, she is the only lawyer selected from India.

JANARDHAN GUPTA
Partner

The government affairs and land acquisition expert has been with MVKini for the last 14 years. A student of STS High School (Minto Circle) and Aligarh Muslim University, Janardhan started his legal carrier representing high profile political figures. He has a solid understanding of the political set-up and the political process across party lines in northern India and has also worked as the personal legal advisor to the Central Cabinet Ministers, helping him organise their social welfare initiatives.

At M.V.Kini he heads the Lucknow and Allahabad offices and handles the land acquisition and real estate/property portfolio in the northern India.

He maintains government relations and has established a network spanning almost every district in northern India. He handles a large number of land acquisition cases on behalf of the National Highway Authority of India.

Ram has more than 15 years’ experience in corporate law. He previously headed the legal department at Jumbo Group, India, a reputed multinational company based at Dubai, UAE with interests in multi-brand electronic retail and manufacturing, chemicals and construction. Sumit is the lead partner at the Delhi office with over 13 years experience in major practice areas of MVKini. S.D. Shetty
Partner

The law firm that S.D. Shetty joined fresh out of law school at Mumbai University in 1987 is virtually unrecognisable to him today. From the tens of clients that the firm had back then, the MVKini of today represents thousands of clients, both in the public and private sector, in several different practice areas across the country.

The partner at the firm has been with MVkini his entire career as a litigation lawyer and specialises in property law, arbitration and documentation relating to agreements, company schemes and property matters. He is also an expert in litigation work in service matters relating to articles 226, 227.

S.D. Shetty has been instrumental in some of the firm’s high profile cases relating to property law. He represented the International Airports Authority of India (IAAI) to help prove their ownership of Mumbai’s Chhatrapati International Airport. The long-running case went from the lower court all the way to the Supreme Court. The decision was given in his client’s favour proving ownership of the property valued at over Rs10bn.

His other landmark cases involved the resolution of the service matter case between the Maharashtra State Electricity Distribution Company and concerned its 12,000 employees. The favourable decision taken in favour of S.D. Shetty’s client in the high court was upheld in the country’s Supreme Court. Whether it is cases relating to infrastructure law relating to highways, airports or family property disputes, his diverse experience in criminal proceedings including in service and property cases of all kinds has served MVKini well.

PADMA PRIYA
Principal Associate

Padma sits within MVKini’s dispute resolution team. With her primary focus on arbitration, she has extensive experience advising clients in arbitral proceedings and in high-value arbitration-related matters in court.

Padma works with clients, advising them on a wide range of civil, commercial and constitutional law-related litigation. She regularly appears before both the original and appellate sides of the Delhi High Court, the Supreme Court of India and various statutory boards, commissions and tribunals.

PRATEUSH SHARMA
Partner

Based out of MVKini’s Mumbai office, Prateush provides support to the tax desks in New Delhi. Prateush has appeared in the Bombay High Court and various benches of the Tax Tribunals across India in a large number of tax litigations. He has successesfully represented several leading manufacturing, engineering, logistics and service sectors companies in tax litigation cases.

The law graduate has nearly twenty years of experience in areas like foreign trade policy (FTP), customs, excise and service tax. His other areas of practice include anti-dumping, FEMA (forex laws) and legal metrology (weights and measures law).

His experienceposure into trade policy and trade taxes arena is multi-dimensional –, he hasving served in the Federal Department of Revenue for more than fifteen years; he has worked a decade and a half, in the area at a law firm and also inin a large manufacturing conglomerate. This experience helped Prateush develop strong analytical and problem solving abilities in representations before authorities.

Prateush has headed the tax function of a 5bn compan. He also lead its risk analysis and management teams developing risk management modules for internal health checks, statutoryaudits and concurrent risk audits.

V. Ramaswamy

In legal practice since 1997, this Madras Law College graduate also has a post-graduate diploma in company law, banking and insurance law.

In a career spanning 27 years, he has worked in the public and private sector, providing specialised commercial-legal services. He has worked in the legal department for large-sized fertilizer, chemical, boiler, cement and sugar plants. His work included drafting, vetting, negotiation and finalisation of contracts with overseas and Indian parties for joint venture arrangements and transfer of technology, expertise, basic and detailed engineering, procurement of equipment/supplies, inspection and expediting services. Abhay Itagi

Vidisha Krishan
Partner

Vidisha obtained her LL.B. degree from the Faculty of Laws at Delhi University. She also holds a degree in Journalism Honours from Delhi University. She has an LL.M. in banking and finance law from the University College London.

Having worked with India’s capital markets regulator, the Securities and Exchange Board of India, she has extensive experience working in law firms as well as in the government. At the Board she was involved in policy formulation and regulation drafting and helped provide informal guidance on various delisting, buyback and takeover issues to listed companies.

Vidisha focuses on capital markets issues as well as cross-border investments into India. She advises on matters relating to RBI/FEMA aspects of cross-border transactions as well as domestic listed and unlisted company issues.
